To guarantee a reservation, a US$ 200 deposit per passenger is required

| POLITICAL
OF CANCELLATION |
The
following fine will apply in case of cancellation of reservations
as soon as Cruceros Australis receives written notice of cancellation.
From
the day of reservation until 45 days before the sailing:
200
Dollars per person. Deposit is not refundable.
From
44 to 30 days before departure: 25% of sales value.
From
29 to 15 days before departure: 50% of sales value.
From
14 to 00 days before departure: 100% of sales value.

CONDITION
OF PASSENGERS CONTRACT Transports Maritimes Terra Australis S.A.
1.-
The passenger ticket contains and specifies the passenger contract
between Transports Maritimes Terra Australis S.A., hereinafter call
"the Company". The passenger contract, as indicated on the
ticket, is governed by the rules and regulations of the Business Code,
book III, of the Republic of Chile. The passenger must carry with
him the ticket issued throughout the trip and shown each time required
by Transports Maritimes Terra Australis S.A. and/or the maritime authorities
at boarding, during the trip and at disembarkation.
2.-
The ticket is valid only for the ship, trip and passenger to whom
issued. Therefore should a passenger not make use of its rights to
postpone or cancel the trip and does not board the ship, loses all
rights to same.
3.-
The ticket once issued, carries the passenger's name and may not be
transferred to another party without the previous and written consent
of Transports Maritimes Terra Australis S.A.
4.-
If a passenger wishes to postpone the trip indicated on the ticket,
changing it to a future date, he must issue a request to the Company
not less than 30 days in advance to departure date. A fee of US$100
will apply. Cruceros Australis may accept postponements within 30
days of departure date with a penalty of 50% of the fare paid. Other
than circumstances indicated above, the passenger does not have any
other right to postpone his trip.
5.-
Cancellation penalties: Should a passenger cancel his trip, Transports
Maritimes Terra Australis S.A. will refund the net value, part of
the net value or may not refund any amount, depending on the length
of time Transports Maritimes Terra Australis S.A. learns of the passengers
decision and is notified in writing of such. The following penalties
will apply:

Cancellation up to 45 days in advance: US$200 per passenger
- Cancellation 44 to 30 days in advance: 75% of the refund
- Cancellation 29 to 15 days in advance: 50% of the refund
- Cancellation 14 to 00 days in advance: No refund
6.- It is strictly forbidden for passengers to carry with them or
in their cabins, firearms, dangerous objects or explosives contained
within the regulations of the Laws of Arms Control. Passengers will
be made responsible for any damage or claims against Transports Maritimes
Terra Australis S.A., its dependents or agents, as a consequence of
passengers bearing or attempting to bear the aforementioned items.
7.-
Passengers who disembark on their own or interrupt their trip at intermediate
ports, must bear all expenses while on land, as well as expenses in
boarding and embarkation taxes, if any. If a passenger fails to return
to the ship by the posted hour of departure, at the embarkation port
or at any of the other stops in which he has disembarked voluntarily,
the captain may sail and the passenger may not demand restitution
of the fare paid, nor any other compensation or indemnity from the
Company.
8.-
The Company reserves the right to refuse boarding any passenger showing
illness, being it mental or otherwise. If a passenger is known to
have or is discovered to have during the trip mental illness or any
other illness or impairment, and at the Captain's discretion is found
to be unable to continue the trip or may hinder the health and security
or well being of the rest of the passengers, may be disembarked at
any intermediate port, before reaching his final destination and may
be forced to stay at said port and secure transportation to his final
destination, on his own and at his expense.
Not included in the fare is the consumption of alcoholic or non-alcoholic
drinks at the bars or any purchases at the ships store. Optional
tours are not included in the fare. Passengers must pay for all items
not included in the fare, at the rates posted on board, in cash.
9.-
Each cabin holds a security box, equipped with a single key handed
to the passenger, in which he should keep, under his sole responsibility,
money, jewelry and any other valuables he wishes to carry on board.
Due to this, Transports Maritimes Terra Australis S.A. will not be
responsible for any damages the passenger may suffer as a consequence
of loss, for whatever cause and/or amount, of money, jewelry and valuables.
Pets are not allowed on board.
10.-
Passengers
must comply with all the rules and regulations posted by the Company
in regards to the transportation of passengers and their luggage,
as well as the instructions from the Captains on board and they will
be denied access to restricted areas.
The Company may cancel de departure of the ship in case of force majeure
or an Act of God, in which case the passengers may not claim refund
of amounts paid or any kind of indemnity. In the event of a delay
in the departure or arrival of the ship, for causes in which the Company
is not responsible, the passenger will be entitled to free lodging
and meals, with no additional payment. If the trip should be permanently
interrupted and is due to force majeure or an Act of God, the passenger
must pay the proportionate amount for the length of trip completed,
without any further indemnity.
11.-
The ship may sail on any route, get in or out of any port with or
without pilots or towing, it can tow or be town and may assist other
ships in any kind of situations, arrive or return to port, deviate
or stop at any port in any sequence, whether they are or not in sequence,
or in the direct course or usual course of the trip and, if obliged
due to quarantine or other government or municipal restrictions or
by force majeure, it may, notwithstanding any other right or remedy
inferred by these conditions, omit any stop at the ports indicated
in the itinerary, without any responsibility for any consequence derived
from said deviation or omission.
12.-
The date and hour of departure stated in the passenger ticket is tentative.
The passenger must reconfirm the departure 48 hours in advance. Transports
Maritimes Terra Australis S.A. will not be held responsible for any
delay in the departure of the ship if caused by force majeure or an
Act of God.
13.-
When the total trip, a portion of it or other services as detailed
on the ticket are provided by means other than the Company, upon issuance
of the ticket the Company contracts for said services acting as agent
of the person, company or entity providing same. As such, all contracts
entered by the Company as agent are subject to the rules and regulations
of these persons, companies or entities.
14.-
In addition to any other right or remedy granted by these conditions,
the Company is free to cancel all its obligations derived from the
passenger contract, without contracting the obligation to refund amounts
due to indemnity for claims and damages to the passenger in case of
force majeure or Acts of God.
15.-
Notwithstanding the designation of the port of destination on the
ticket, in the event that, by order or request of any competent authority
or one deemed as competent to issue such an order or request, or given
the terms of the ship's insurance against risks of war, should it
be, for any reason, deviated to any port not being the one designated
in the ticket as the port of destination, the responsibility of the
Company, by virtue of this contract, ends the moment the ship arrives
at the port to which it has been deviated.
16.-
The ship is free to comply with any order or institutions regarding
cargo, departures, routes, intermediate ports, interruptions, transshipments,
off loading, arrivals at destination or any others that may be issued
by competent authorities. In the event that the Company is precluded,
by reason of said orders, to disembark passenger's at the port of
destination shown in the ticket, the Company has the right to disembark
them at any other port in which the ship is stopping (whether said
port is before or after the port of destination) and the passenger's
contract included in the ticket will be considered met and fully executed
in the prescribed manner and the responsibilities of the Company will
cease at that moment. The Company will not be forced to refund the
passenger the total or partial value of the fare nor be responsible
to pay or handle the passenger's return to its destination, nor refund
any expenditures the passenger may incur while on land while awaiting
the continuance of his trip to destination, or for any other reason.
18.-
Any dispute between the passenger and the Company, shall be governed
by the rules and regulations of the Business Code, Book III, of the
Republic of Chile.
